These Terms of Service (“Agreement”) govern your access to and use of the websites www.startbyus.com and platform.startbyus.com (“Platform”) operated by StartByUs Technologies Private Limited (“StartByUs”, “we”, “us”, or “our”).

By registering as a Candidate or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.

1. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts under applicable law.

2. Nature of Platform

StartByUs is a technology platform that connects Candidates, Employers, Recruiters, and Business Developers.

We are not an employer, employment agency, staffing company, or recruitment consultant.

We do not guarantee:

• Job offers
• Interview calls
• Employment opportunities
• Salary outcomes
• Employer responses

3. Candidate Account

You agree to:

• Provide accurate, current, and complete information
• Maintain confidentiality of your account credentials
• Be responsible for all activity under your account
• Update your profile information whenever necessary

We reserve the right to suspend or terminate accounts containing false, misleading, incomplete, or fraudulent information.

4. Resume and Profile Information

By uploading your resume or profile information, you confirm that:

• The information provided is true and accurate
• You own or have the right to share the uploaded content
• You are authorized to share employment history and personal details

You understand that Employers and authorized Recruiters may access your profile and resume through the Platform.

5. Candidate Consent

By registering on the Platform, you consent to:

• Your profile being shared with Employers and Recruiters
• Being contacted regarding job opportunities
• Receiving emails, calls, SMS, or notifications related to recruitment activities

You may withdraw consent or deactivate your account subject to applicable legal and operational requirements.

6. Prohibited Activities

You must NOT:

• Provide false, misleading, or fraudulent information
• Create duplicate accounts
• Impersonate another person or entity
• Upload malicious software, viruses, or harmful content
• Use bots, scraping tools, or automated systems
• Misuse the Platform or interfere with its operation

7. Job Applications and Recruiter Submissions

You acknowledge that Recruiters may submit your profile to Employers only after obtaining your consent.

StartByUs is not responsible for:

• Recruiter conduct
• Employer decisions
• Interview processes
• Offer withdrawals
• Employment disputes

8. Data Protection and Privacy

We process personal information in accordance with applicable laws including the Digital Personal Data Protection Act, 2023 (India).

By using the Platform, you consent to our collection, storage, processing, and sharing of your data for recruitment-related purposes.

9. Intellectual Property

All Platform content, branding, software, and systems belong to StartByUs.

Unauthorized copying, reproduction, or misuse is prohibited.

10. Disclaimer of Warranties

The Platform and Services are provided on an “AS IS” and “AS AVAILABLE” basis.

We do not guarantee uninterrupted availability, accuracy, or suitability of job listings or services.

11. Limitation of Liability

To the maximum extent permitted by law, StartByUs shall not be liable for:

• Loss of employment opportunities
• Employer or Recruiter conduct
• Interview outcomes
• Salary disputes
• Indirect or consequential damages

Our total liability shall not exceed the amount paid by you, if any, for use of the Platform in the preceding 12 months.

12. Indemnification

You agree to indemnify and hold harmless StartByUs from any claims, damages, liabilities, or legal actions arising from:

• Your misuse of the Platform
• Your violation of these Terms
• Your submission of false or unlawful information

13. Suspension and Termination

We may suspend or terminate your account at any time without prior notice for:

• Violation of these Terms
• Fraudulent activity
• Misuse of the Platform
• Legal or compliance requirements

14. Third-Party Links and Services

The Platform may contain links to third-party websites or services.

We are not responsible for third-party content, policies, or actions.

15. Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control.

16. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of India.

Any disputes arising out of or relating to these Terms shall be resolved through arbitration under the Arbitration and Conciliation Act, 1996.

17. Modifications

We may modify these Terms at any time.

Continued use of the Platform after updates constitutes acceptance of the revised Terms.

19. Entire Agreement
